Congestion Pricing in the Courts, Part III: Federal vs. State Power and the Ongoing Role of NEPA Review

On Feb. 19, 2025, the U.S. Secretary of Transportation issued a letter to Governor Hochul informing her that the Federal Highway Administration was revoking its approval of New York’s congestion pricing program, and the MTA immediately challenged the Secretary in federal court. In this article, Christine Billy discusses the role of the National Environmental Policy Act in the case and then explores what is at stake in this federal vs. state power clash.
